Account Agreement & Disclaimer
Required before creating an account and before buying or selling
Stackwize does not set, control, or guarantee market prices.
Trading card values are highly volatile and can change rapidly based on market demand, supply, grading population, player performance, set releases, economic conditions, and other factors outside of Stackwize’s control.
Past sales data shown on Stackwize is for informational purposes only and does not constitute a guarantee of future value. Prices can rise or fall significantly in short periods of time. You are solely responsible for your own purchasing and selling decisions. Stackwize is not responsible for any financial loss resulting from changes in market conditions.
This Market Conditions Advisory applies to every transaction and is a core part of using the platform.
1. Required Ethics Course + Test
No account may buy or sell until the Stackwize Ethics Course is completed and the final test is passed. The course uses a Duolingo-style format (short interactive lessons). It covers fiduciary duties, honest representation, personal liability for fraud, and the 3-Strike system. Passing the test is a condition of access. Attempting to bypass or falsify completion is grounds for permanent ban.
2. Nature of the Platform
Stackwize is a marketplace that connects buyers and sellers of card singles only (sports cards, Magic: The Gathering, Pokémon, and similar). No sealed products, bulk lots, or other items are permitted. We provide tools, data, and buyer protection services, but we are not the seller of the cards (unless explicitly stated).
Stackwize is designed as a unified platform that brings together the ethical standards, transparency rules, and protection systems developed across related Stackwize projects into one trusted marketplace.
3. Fiduciary Duties & Personal Liability
Sellers are expected to act with honesty and fair dealing toward buyers.
Sellers will be held personally liable in the event they defraud someone. Platform protections do not shield a seller who engages in intentional fraud, misrepresentation of authenticity/condition, or other deceptive practices. Stackwize may pursue recovery and cooperate with appropriate authorities.
4. Three-Strike System
- Strike 1 — Warning + required corrective action
- Strike 2 — Temporary suspension and/or elevated scrutiny
- Strike 3 — Permanent removal from the platform
Serious fraud or clear intentional harm may result in immediate permanent ban without progressive strikes. Elite status does not protect against strikes or bans for violations.
5. Shipping, Tracking & Insurance
- All shipments must include tracking and insurance covering the full purchase price.
- Sellers are responsible for following Stackwize packaging standards and purchasing the required tracking and insurance.
- Stackwize provides a buyer protection guarantee for lost or damaged packages when the Seller has followed platform requirements.
- Sellers who fail to properly package, track, or insure an item may be held liable.
6. General Liability
- Stackwize’s total liability for any claim related to a transaction shall not exceed the purchase price of the item plus original shipping costs.
- Stackwize is not liable for indirect, consequential, incidental, or special damages of any kind.
- You agree to release Stackwize, its owners, operators, and agents from any claims arising from market price fluctuations, seller performance (except as covered by our buyer protection policy), or your own decisions.
7. Account Responsibility
You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to comply with all platform rules.
8. Prohibited Activity
You agree not to engage in fraud, misrepresentation, shill bidding, price manipulation, or any activity that harms the integrity of the marketplace.
9. Acceptance
By creating an account and unlocking buying/selling privileges, you confirm that you have successfully completed the required Stackwize Ethics Course, passed the final test, and that you have read, understood, and agree to this Agreement, including the Market Conditions Advisory, fiduciary expectations, personal liability for fraud, and the 3-Strike system. This agreement is binding.
